Marriage and nikah: your position in Islam and in English law
A nikah marries you in Islam. In England and Wales, a marriage is usually recognised in law only if it is also legally registered. We help you check that your marriage is sound in your religion and, if you choose, recognised in English law. Then both of you know where you stand.
What a nikah is, and what the law sees
A nikah is a complete Islamic marriage, establishing the rights and responsibilities of both spouses. In your religion, once the conditions are met, you are fully married.
English law does not automatically recognise a nikah held in England or Wales. The marriage must be legally registered. This can be at a register office, at an approved venue, or at a mosque registered for marriages with an authorised person present. A nikah held abroad may be recognised if it was valid under the law of that country.
Why this matters, especially for women
Many Muslim couples in the UK have a nikah but do not register the marriage. A nikah-only ceremony held in England or Wales is usually treated in law as no marriage at all (a “non-qualifying ceremony”).
If the relationship breaks down, an unregistered spouse, most often the wife, may have no automatic legal right to the family home or to maintenance. She may also have no right to a share of what was built up during the marriage.
If you have a nikah but have never registered it civilly, it is worth checking your position now.
How we help
We check where your marriage stands, in your religion and in law.
- Guidance on performing a nikah properly, so it is valid and complete in Islam
- Helping you arrange legal registration of the marriage
- Reviewing an existing nikah to see whether it is legally recognised
- Recording both spouses’ rights, including the mahr, in writing
- Preparing a prenuptial or postnuptial agreement: our scholar checks the Islamic terms and our solicitor drafts it
Where formal legal steps are needed, these are carried out by our partner solicitors.
